📅

Enforcement Timeline & Status

The EU AI Act entered into force in August 2024 and applies in stages:

  • 2 February 2025: Mandatory AI Literacy requirement active for all personnel using or managing AI.
  • 2 August 2026: Main body of the Regulation applies (including transparency & risk classification rules).
  • 2 August 2027: High-risk obligations for regulated products phase in completely.

Risk-Based Approach

The Act classifies AI systems according to their potential impact. Higher potential impact carries heavier regulatory duties:

Risk Category AI System Use Cases Regulatory Treatment
Prohibited Manipulative or exploitative AI, social scoring, certain biometric & predictive profiling Strictly Banned across all EU jurisdictions
High-Risk Recruitment, employee management, credit scoring, education, critical infrastructure, safety components Heavy documentation, risk assessments, logs & mandatory human oversight
Transparency Chatbots, deepfakes, synthetic content & generative AI applications Mandatory disclosure & machine-readable content identification
Minimal / Limited Most ordinary productivity, analytics, search & lower-risk business software Minimal AI Act obligations (voluntary code of conduct)
Definition 01

Provider Status

An organization that builds or places an AI system/model on the market. Carries heavy technical, auditing, and documentation obligations.

Definition 02 (Applies to Most Businesses)

Deployer Status

A company that uses an AI system supplied by a third party. An ordinary European business using third-party AI tools still holds direct compliance duties under the Act.

What This Means in Practice for Companies

For most businesses, AI Act compliance is an operational governance and management priority — not just a theoretical legal exercise.

The Practical C-Suite Work Includes:

1Identifying all AI systems & tools currently in use across the organization.
2Mapping which departments & employees are actively using AI tools.
3Classifying every AI use case by its official risk level.
4Determining which systems require additional controls & documentation.
5Establishing an enforceable internal AI Policy.
6Creating a structured approval process for new AI software & tools.
7Assessing AI vendors before company data or processes are exposed.
8Establishing appropriate human oversight for automated workflows.
9Documenting higher-risk AI applications for audit readiness.
10Coordinating AI governance with GDPR, cybersecurity, and compliance.
11Defining clear internal approval authority for AI deployments.
12Defining monitoring roles and problem/incident reporting procedures.
13Ensuring employees have mandatory AI Literacy (enforceable since 2 Feb 2025).

Transparency Requirements (Effective 2 August 2026)

Additional transparency rules apply to customer-facing and internal content generation tools:

  • People must be informed when interacting with an AI system (e.g. customer support bots).
  • Certain AI-generated or synthetic content must be clearly identifiable.
  • Deepfake media must be explicitly disclosed as artificially generated.
  • Some AI-generated output requires embedded, machine-readable identification tags.
